ACCEPTANCE OF PRIVACY POLICY AND ANY REVISIONS THERETO

PERSONAL INFORMATION and PUBLIC INFORMATION

personal information about You that is publicly available information, such as information available through government sources (such as Land Titles/Registry offices, municipal departments and/or provincial regulators), public registries, telephone books, directories, online directories, social media sites, such as LinkedIn, Facebook, etc.
aggregated information that cannot be associated with You as a specific individual; and
information which is not about You, but which is about any company, association, organization, club, etc., with which You are associated.

Public information is not governed by the personal information policies in this Privacy Policy.

99homes may share Your public information and any modifications and updates thereto by You, with a developer, owner or agent of the developer/owner of a real estate project or other developer or investor for or in real estate or any affiliate (each, the “Developer”) and/or with a real estate agent, broker, brokerage and real estate consultant or any affiliate (each, the “Real Estate Agent”), and with real estate boards, associations or regulators, financial institutions, the providers of goods and services and government agencies and You hereby consent thereto. For instance, 99homes may share Your public information with one or more Developers and/or Real Estate Agents with respect to a real estate project or projects, for the purposes of such Developers and/or Real Estate Agents contacting You in respect thereto. For instance, 99homes may share Your public information with rewards suppliers under 99homes’s Bottom Line Rewards Program (“Rewards Suppliers”), for the purposes of such Rewards Suppliers contacting You with respect thereto. For instance, 99homes may share Your public information with providers of products and services as they relate to real estate and/or the ownership and/or the occupancy thereof. Information You share with these entities will be subject to those entities’ privacy policies.

The Site may host public forums, postings, message boards, blogs, social media sites, social feed sites, newsgroups, review groups and/or other public sites. Information which You disclose or post in these areas of the Site becomes public information and is not governed or protected by the personal information policies in this Privacy Policy.

COLLECTION OF PERSONAL INFORMATION ON USE OF THE SITE

99homes may collect personal information through Your use of the Site, various contracts, forms or documents You complete and/or other activities initiated through the Site. This occurs when You register at the Site, access and use the Site and its functions, use any of the services or products that are provided at the Site from time to time or otherwise by 99homes specifically requesting the personal information from You at the Site.

This information may also be used for tracking procedures, such as tallying the number of page views on the Site and of such administrative matters and to gather broad, aggregated demographic information. 99homes may also use this information where it is otherwise permitted by law.

The Site is not directed to children. No communication will be sent to anyone or information collected from anyone who indicates that he/she is younger than 16 years of age.

COOKIES

99homes may use cookies (information that the Site transfers to Your hard drive for record-keeping purposes) for a number of purposes including Your use of the Site. Cookies help 99homes to track use at the Site. 99homes may use this information for improvements and updates to the Site.

Since personal information may be collected through registration at the Site and the use of the Site, including using any of the services or products that are provided at the Site from time to time, this personal information shall be disclosed by 99homes to its affiliates, as necessary or desirable to provide the required services, and to the Developer and/or the Real Estate Agent and/or Rewards Suppliers, in each case as necessary, and You hereby consent thereto. 99homes and its affiliates may use Your personal information to better meet Your needs and to better provide service to You through this Site and such affiliates’ websites of 99homes for services in the real estate business, and You hereby consent thereto.

99homes may disclose aggregated statistics (where 99homes discloses a characteristic or characteristics of users of the Site, as a group, and not as individuals) in order to describe and/or promote this Site, the services of 99homes and to prospective Developers and/or Real Estate Agents and/or Rewards Suppliers and for other lawful purposes.

The personal information You provide through registration at and accessing and use of the Site may be aggregated in order to show and promote the use of the Site. For example, 99homes may provide to the Developer and/or the Real Estate Agent, summaries of service success rates, inventory of units sold, either for the Developers’ projects and/or the Real Estate Agents or for the Site in general and over any given period of time.

From time to time, You may receive the material, promotional and/or marketing literature or special offers from 99homes, the Developers and/or the Real Estate Agents and/or Rewards Suppliers and/or third parties. To provide this information, 99homes may share Your public information including Your name, contact information and email address and some or all of Your personal information with the Developer and/or the Real Estate Agent and/or Rewards Suppliers and/or third parties, and you hereby consent thereto. 99homes may also communicate with You about additional real estate services or to provide information to You about other products and services which may interest You. You may inform 99homes that you do not wish to receive this information. You may continue to access the Site even if You have so advised 99homes.

99homes or the Developer and/or the Real Estate Agent and/or Rewards Suppliers may disclose Your personal information to perform credit checks or to collect accounts owed to 99homes or the Developer and/or the Real Estate Agent and/or Rewards Suppliers, to prevent fraud, to prevent money laundering or to request information about You from the files of consumer reporting agencies.

LINK TO THIRD PARTY WEBSITES

99homes may direct You to a third party website or there may be links to third party websites from the Site, that take You outside 99homes’s Site. These websites may send their own cookies to You or otherwise collect data or solicit information. 99homes has no control over those websites and is not responsible for the content or for the use by them of any data or information collected. 99homes cannot be held liable for Your access and use of such third party websites.

INDEMNITY

If applicable, You will be providing to 99homes personal information on behalf of any person or entity on whose behalf You are accessing the Site and the services available thereat, You agree that You have abided by any applicable personal information protection legislation. You acknowledge that 99homes and the Developer and/or the Real Estate Agent and/or Rewards Suppliers will rely on the personal information which You provide and You agree to indemnify each of them, if such information is not accurate and/or is provided in contravention of any application personal information protection legislation and/or without the consent and approval of the owner of the personal information. If applicable, You confirm that 99homes may rely on You to have explained this Privacy Policy to such person or entity, to have confirmed that they are in agreement with Your access and use of this Site on their behalf and to have any information You provide on their behalf governed by this Privacy Policy.

CONSENT

99homes collects personal information where it is necessary to provide its services which You are seeking on or in association with the Site. You hereby consent to the use of Your personal information for the purposes set out herein and at the Site. 99homes shall disclose Your personal information to the Developer and/or the Real Estate Agent and/or Rewards Suppliers and You hereby consent thereto. You specifically consent to the use of Your personal information in conjunction with the online use any of the services or products that are provided on the Site as You may use them from time to time.
99homes reserves the right to collect, use and disclose Your personal information, where it is required or allowed to by law, including any appropriate personal information protection legislation, without Your knowledge or consent, to any third parties, without first obtaining Your consent.
99homes may disclose Your personal information to the Developer and/or the Real Estate Agent for the sale, rent, lease, financing, mortgages, and insurance of condominiums, townhouse or other real estate developments, for the purposes of contacting You for the promotion and sale of such real estate or developments.
99homes may disclose Your personal information to Rewards Suppliers, for the purposes of contacting You in connection with the redemption of Rewards. Also, Your personal information may be used to inform You of other products or services available through the Developer and/or the Real Estate Agent and/or Rewards Suppliers. You hereby consent to these uses.
99homes may share personal information with third party service and product partners engaged in assisting 99homes in providing services to You or in carrying out one or more of the purposes for the use and access of the Site. These service and product providers will not use such personal information for any purpose, other than to provide such assistance and are required to protect personal information disclosed to them by 99homes and to comply with the general privacy principles described in this Privacy Policy. You hereby agree that 99homes is collecting Your personal information through Your access and use of the Site, with Your consent, and 99homes is relying on that consent. Further, where the purpose of the collection of the personal information is obvious, 99homes may rely on Your implied consent and You agree to that.
In some cases, 99homes may rely on opt-out consent, in that You will receive certain information from 99homes unless You advise 99homes that You do not wish to receive it at that time.

99homes reserves the right to collect, use and disclose personal information in certain limited circumstances, without Your knowledge and consent:

99homes reserves the right to disclose personal information, without Your knowledge and consent to create aggregate information, in order to identify user needs and trends, to aid in the development of new services and products and to promote and market 99homes’s services to the Developers and/or the Real Estate Agents and others.

If You wish to withdraw Your consent at any time, please contact 99homes at the email address set out below. At that time, 99homes will inform You of the implications of withdrawing Your consent.

In addition to the above, in certain circumstances, 99homes may seek consent from You, for the purposes of use and disclosure of Your personal information, which goes beyond that described herein and may use Your personal information to contact You for that consent.

ACCESS TO AND RETENTION OF YOUR PERSONAL INFORMATION

Applications in writing for access to Your personal information in the possession or custody of 99homes may be sent to 99homes at the email address set out below. Applications must be sufficiently detailed to allow 99homes to identify You and the personal information You are requesting. 99homes reserves the right to refuse to comply with all or a part of a request, where 99homes has concerns about the use of the personal information to be disclosed to You or is permitted to refuse by the provisions of applicable personal information protection legislation.

If You are of the view that some of Your personal information needs to be changed (such as updating Your address, etc.), 99homes will endeavour, upon receipt of those changes, to correct that information. If You wish, for any reason, to update Your personal information, You may email 99homes at the email address set out below. If 99homes is satisfied that the correction is reasonably necessary, 99homes will change the personal information. If 99homes is not satisfied that the correction should be made, 99homes will not make the change.

Requests for access and correction may be responded to by 99homes, within thirty (30) days of receiving the request, unless 99homes applies to the applicable privacy commission for an extension. 99homes will charge for providing You with copies of Your personal information.

99homes will not grant You access with respect to Your personal information where it would have an unreasonable impact on another person’s personal information or privacy. Further, it will not provide access to Your personal information where Your request is frivolous or vexatious.

99homes retains Your personal information for as long as necessary, to fulfill the purposes for which it was collected, the purposes set out herein and to comply with applicable law. You consent to 99homes retaining Your information on this basis.

When 99homes’s need for Your personal information ends (in conformity of the Terms of Use and this Privacy Policy), Your personal information will be removed from the 99homes Site and be security destroyed.
